If you are a dependant of a Turkish citizen who is established in business in the UK under the provisions of the European Community Association Agreement (ECAA) with Turkey, you can apply for leave to enter or remain in the UK in this capacity.

There are two ways of applying to extend your permission to remain as a dependant of a Turkish ECAA Businessperson:

  • a Turkish ECAA businessperson can include their dependent(s) on their own application form (form ECAA 2 for businesspersons); or
  • the dependant can apply separately using application form ECAA 3 Turkish Dependant.

Dependants applying for permission to remain in the United Kingdom may be penalised if they are not lawfully present in the United Kingdom when the application is made.

You qualify as a dependant if you are the husband, wife, civil partner, unmarried partner, same-sex partner or child of a person who has valid permission to be in the United Kingdom as a Turkish ECAA Businessperson.

Family members seeking leave to remain will only be granted leave if they can show that they have, or were last granted, leave as the family member of a Turkish ECAA businessperson or leave as the family member of a person with leave under another category of the rules who has since been, or is at the same time being, granted leave as a Turkish ECAA businessperson.

Family members applying for indefinite leave to remain will need to do so at the same time as the Turkish ECAA businessperson and must be able to show that they have, or were last granted, leave as the family member of a Turkish ECAA businessperson.
